Terms of service


1. General/Applicability 

All services by createasmilestamps.com base on these terms and conditions.

 

2. Offer 

The contract comes about through the completion of the ordering process on the website of createasmilestamps.com and order confirmation by createasmilestamps.com by e-mail or execution of the order. 

 

 3. Prices and terms of payment 

The prices shown on the createasmilestamps.com website at the time of the order apply. All prices are final prices in currency of your choice. Packaging and shipping costs will be charged separately. createasmilestamps.com accepts all payment methods offered on the website within the ordering process. The customer chooses his preferred payment method himself. Any additional costs (e.g. cash on delivery fee) arising from the payment method will also be charged separately.

  

4. Delivery, delivery times and shipping costs

 

4.1 Shipping costs 

The goods are delivered to the customer by Deutsche Post / DHL. The shipping costs are calculated as follows: 

Germany:

 • €2.50 for shipping with Deutsche Post 

 If a consignment is sent back to us - due to an incorrect address in the address data or because the delivery was not found and not picked up in a post office (in short: all errors that were not caused by createasmilestamps.com and lead to a return of the package to us), the shipment can be sent again after another payment of €2.50. 

Create A Smile reserves the right to cancel undeliverable orders and refund the paid amount.

  

International: 

• €4.10 for shipping with Deutsche Post 

 If a consignment is sent back to us - due to an incorrect address in the address data or because the delivery was not found and not picked up in a post office (in short: all errors that were not caused by createasmilestamps.com and lead to a return of the lead the package to us), the shipment can be sent again after another payment of €4.10.

  

4.2 Delivery times 

Unless otherwise stated on the product, goods in stock will be shipped within three working days after receipt of payment. If the goods you have ordered are not in stock, we will contact you immediately. If the delivery fails for reasons for which createasmilestamps.com is not responsible, createasmilestamps.com can withdraw from the contract. createasmilestamps.com undertakes to inform the customer about this in a timely manner. Any payments made will be refunded immediately. In this case, the customer has no right to compensation. 

Partial deliveries are permitted; in this case, the costs for transport and packaging will only be charged once. 

 

5. Instructions on the right of withdrawal 

 

5.1 Instructions on revocation/right of revocation 

You have the right to revoke this contract within fourteen days without giving a reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. To exercise your right of withdrawal, you must contact us at:

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. 

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired. 


Consequences of revocation 

If you revoke this contract, we will pay all payments that we have received from you (excluding shipping fees, if the order has already been shipped)) immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. 

For this refund, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this refund payment. We may refuse refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. 

The deadline is met if you send back the goods before the period of fourteen days has expired. The buyer bears the cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. 


5.2 Cancellation of workshops and events 

If participation in a booked event is not possible, Create A Smile must be informed by email at info@createasmilestamps.com. If it is possible to reassign the space, Create A Smile will fully refund the booking fee. 

Otherwise the following cancellation fees apply: 

Up to 22 calendar days before the start of the event: free cancellation, no fee 

21 to 7 calendar days before the start of the event: 50% of the participation fee 

Less than 7 calendar days before the start of the event: 100% of the participation fee 

If you do not attend or cancel the seminar, you are not entitled to a refund of the course fee. The course place is transferable and can be occupied by a representative after consultation with Create A Smile. If the workshop has to be canceled by the organizer, the entire participation fee will be refunded.


5.3 Special information 

According to § 312g BGB, the revocation is excluded for downloadable products, magazines or for the delivery of goods that have been manufactured according to customer specifications. Obvious defects (in particular damage, incorrect deliveries or quantity discrepancies), transport damage or other defects must be reported to createasmilestamps.com in writing immediately, but no later than within a period of 14 calendar days after receipt of the goods. Notification by email to info@createasmilestamps.com is sufficient.

 

6. Passing of risk 

If the customer is an entrepreneur, the risk of accidental loss and/or accidental deterioration of the goods passes to the customer upon handover, in the case of mail-order sales upon delivery of the goods to the parcel service or the person otherwise responsible for carrying out the shipment . 

If the buyer is a consumer, the risk of accidental loss and/or accidental deterioration of the goods sold only passes to the buyer when the item is handed over, even in the case of mail-order sales. The handover is the same if the customer is in default of acceptance. 

 

7. Warranty

createasmilestamps.com guarantees that the goods sold are free of material and manufacturing defects at the time of the transfer of risk and have the contractually guaranteed properties. The statutory warranty period of two years from invoicing applies. The warranty does not cover normal operational wear and tear. Claims by the customer for damages, e.g. due to non-performance, breach of contractual ancillary obligations, consequential damage, damage from tort and other legal grounds are excluded. 

With the exception of this, createasmilestamps.com is liable in the absence of a guaranteed property, in the event of intent or gross negligence. Claims under the Product Liability Act are not affected. If defects occur for which createasmilestamps.com is responsible, and if the replacement delivery is also defective in the case of an exchange of the goods, the buyer has the right to conversion or reduction. createasmilestamps.com assumes no liability for the constant and uninterrupted availability of its own website or for technical or electronic errors in the online offer.

  

8. Retention of Title

All deliveries are subject to retention of title. 

The delivered goods remain the property of createasmilestamps.com until the purchase price has been paid in full.

 

9. Additional Provision 

We reserve the right to adapt or change the general terms and conditions at any time if necessary. In the event that one provision of these general terms and conditions should be ineffective, the validity of the other provisions will not be affected. This particularly applies to the contract already concluded. The other provisions and in particular the contract will not become void and will remain valid. The invalid provision will then be replaced by one that comes as close as possible to the invalid clause in terms of economics and intent. Subsidiary agreements and other deviations from the contract text or our terms and conditions always require the written form and its confirmation.
